Privacy Policy
Last updated: 31 May 2026
1. Introduction
1.1 Blue Sky Chat USA LLC (we, us or our) operates the "Blue Sky Chat" online live-chat and lead-generation service (Service) and the website at www.blueskychat.com (Site). We are committed to protecting the privacy of the personal information we handle.
1.2 This Privacy Policy explains what personal information we collect, how we use and disclose it, how we protect it, and the rights and choices available to individuals — including California residents under the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act (together, the CCPA).
1.3 This Privacy Policy is governed by the laws of the State of California, United States of America, and forms part of and is subject to our Terms & Conditions, including the limitations and exclusions of liability set out in those Terms. By accessing the Site or using the Service, you acknowledge that you have read and understood this Privacy Policy.
2. Scope
2.1 This Privacy Policy applies to personal information we collect through the Site, the Service, and our communications with you. It does not apply to information handled by our clients on their own websites, or by any third party we do not control.
2.2 "Personal information" means information that identifies, relates to, describes, or could reasonably be linked with a particular individual or household, as defined under the CCPA. It does not include publicly available, de-identified or aggregated information.
3. Information We Collect
3.1 Depending on how you interact with us, we may collect the following categories of personal information:
- Identifiers — such as name, email address, phone number, postal address, IP address and online identifiers.
- Commercial information — such as the services you enquire about, purchase or subscribe to, and billing details.
- Internet or network activity — such as interactions with the Site, chat transcripts, pages viewed, referring source, and device and browser information.
- Geolocation data — such as approximate location derived from your IP address.
- Inferences — drawn from the above to understand preferences and lead quality.
3.2 Where we operate live chat on a client's website, we may collect personal information from that website's visitors (Clients) on our client's behalf. That information is handled in accordance with this Policy and our agreement with the relevant client.
3.3 We do not intentionally collect "sensitive personal information" as defined under the CCPA, and we ask that you do not submit it to us.
4. How We Collect Personal Information
4.1 We collect personal information directly from you (for example, when you complete a form, request a quote, subscribe, or chat with us), automatically through cookies and similar technologies (see our Cookie Policy), and from our clients and third-party service providers.
4.2 Where we obtain personal information that we did not request, we will either delete it or handle it in accordance with this Policy and applicable law.
5. How We Use Personal Information
5.1 We use personal information for the following business and commercial purposes:
- to provide, operate, maintain and improve the Service and Site;
- to generate, qualify and deliver leads to our clients;
- to respond to enquiries, provide quotes and customer support;
- to process payments and manage subscriptions;
- to send service communications and, where permitted, marketing (which you may opt out of at any time);
- to detect, prevent and address security incidents, fraud and misuse; and
- to comply with our legal obligations and enforce our agreements.
6. How We Disclose Personal Information
6.1 We may disclose personal information to: our clients (for leads generated on their behalf); service providers and contractors who process information on our behalf (such as hosting, CRM, payment, email and analytics providers) under contractual confidentiality obligations; professional advisers; and to government or law-enforcement authorities where required or permitted by law.
6.2 Lead generation — your consent and authorization. Blue Sky Chat is a lead-generation service. When you provide your details (such as your name, email address or phone number) through a chat, form or other interaction on a website operated by or on behalf of one of our clients, you acknowledge, consent to and expressly authorize us to pass those details to the relevant business or client so that they may respond to, follow up with and contact you. Delivering your details to that business is the very purpose for which you provide them and is an essential and intended part of the Service.
6.3 We do not sell your personal information for money. To the extent that delivering your details to the relevant business or client — or any other disclosure described in this Policy — would constitute a "sale" or "sharing" of personal information under the CCPA, you expressly authorize and consent to that disclosure as a necessary part of the lead-generation Service you have chosen to engage with. Where applicable, you may exercise any opt-out right as described in Section 7.
6.4 We may transfer personal information in connection with a merger, acquisition, financing or sale of assets, subject to this Policy.
7. Your California Privacy Rights
7.1 If you are a California resident, the CCPA gives you the right, subject to certain exceptions, to:
- Know / Access — request the categories and specific pieces of personal information we have collected about you;
- Delete — request that we delete personal information we collected from you;
- Correct — request that we correct inaccurate personal information;
- Opt out — opt out of any "sale" or "sharing" of your personal information;
- Limit — limit the use and disclosure of any sensitive personal information; and
- Non-discrimination — not be discriminated against for exercising your rights.
7.2 To exercise any of these rights, contact us using the details in Section 13. We will verify your request by confirming information we already hold about you. You may use an authorized agent, who must provide proof of authorization.
7.3 We will respond to verifiable requests within the timeframes required by the CCPA. If we cannot fulfil a request, we will explain why to the extent permitted by law.
8. Data Retention
8.1 We retain personal information only for as long as necessary to fulfil the purposes set out in this Policy, to comply with our legal, accounting and reporting obligations, and to resolve disputes and enforce our agreements, after which it is deleted or de-identified.
8.2 On termination of a client account, chat history and related data associated with that account may be deleted in accordance with our Terms & Conditions.
9. Data Security
9.1 We implement reasonable administrative, technical and physical safeguards designed to protect personal information against loss, misuse and unauthorized access, disclosure or alteration.
9.2 However, you acknowledge and agree that no method of transmission over the internet or method of electronic storage is completely secure, and we cannot and do not warrant or guarantee absolute security. To the maximum extent permitted by applicable law, you provide personal information at your own risk, and we are not liable for any unauthorized access to, or loss, misuse or alteration of, personal information that occurs despite our reasonable safeguards or that is caused by events or third parties beyond our reasonable control.
10. Third-Party Websites and Services
10.1 The Site and Service may link to or rely upon third-party websites, platforms and services that we do not control. We are not responsible or liable for the privacy or security practices, content, or any act or omission of any such third party. Their collection and use of information is governed by their own policies, and we encourage you to review them.
11. Children's Privacy
11.1 The Service is not directed to children, and we do not knowingly collect personal information from individuals under 16 years of age. If you believe a child has provided us personal information, please contact us and we will take reasonable steps to delete it.
12. Disclaimers, Limitation of Liability and Changes
12.1 The Site, the Service and this Privacy Policy are provided on an "as is" and "as available" basis. To the fullest extent permitted by applicable law, we disclaim all warranties, express or implied, in connection with the handling of personal information.
12.2 To the maximum extent permitted by applicable law, neither Blue Sky Chat USA LLC nor its officers, directors, members, employees, contractors or agents will be liable for any indirect, incidental, special, consequential, punitive or exemplary damages, or for any loss of data, profits, revenue, goodwill or reputation, arising out of or in connection with the collection, use, disclosure, loss or processing of personal information, however caused and on any theory of liability, even if advised of the possibility of such damages. Our total aggregate liability in connection with this Privacy Policy is subject to, and shall not exceed, the limitation of liability set out in our Terms & Conditions.
12.3 You agree to indemnify and hold harmless Blue Sky Chat USA LLC and its officers, directors, members, employees, contractors and agents from any claim arising out of personal information you provide to us, or your breach of this Policy or any applicable law.
12.4 We may amend this Privacy Policy at any time by posting the updated version at www.blueskychat.com. Changes take effect when posted, and your continued use of the Site or Service constitutes acceptance of the amended Policy. Please review it periodically.
12.5 Nothing in this Privacy Policy excludes, restricts or modifies any right or remedy, or any guarantee, warranty or liability, that cannot lawfully be excluded, restricted or modified under applicable law (including the CCPA). Where such liability can be limited but not excluded, our liability is limited to the maximum extent permitted by law. If any provision of this Policy is found unenforceable, the remaining provisions continue in full force.
